Cancellation Policy for Consumers

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods. If several goods from a single order are delivered separately, the period begins upon receipt of the last item; for partial shipments or pieces, it begins upon receipt of the last partial shipment or the last piece.

You may use the model cancellation form below, but this is not mandatory.

For online orders, you may also use the clearly visible “Cancel contract” function.

To meet the cancellation deadline, it is sufficient to send the notification that you are exercising your right of cancellation before the cancellation period expires.

Consequences of cancellation

If you cancel this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery offered, without undue delay and no later than fourteen days after receiving your cancellation. Unless otherwise agreed, we will use the same payment method for the reimbursement as was used for the original transaction; you will not be charged any fees for the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you sent the goods back, whichever occurs first.

You must return or hand over the goods to HKS Heizung/Klima/Sanitär, Höhnkoppel 22, 22179 Hamburg, Germany, without undue delay and no later than fourteen days after making your cancellation declaration. The deadline is met if you send the goods before the fourteen-day period expires.

You bear the direct cost of returning goods that can be sent as parcels. For goods that cannot be sent as parcels, the direct return cost is estimated at no more than EUR 249, unless a lower specific estimate is stated in the offer.

You are liable for any loss in value only if it results from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

Exceptions

The right of cancellation does not apply in particular to goods that are not prefabricated and whose production is governed by an individual choice or specification, or that are clearly tailored to personal needs. It may cease to apply to sealed goods that are unsuitable for return for reasons of health protection or hygiene if the seal was removed after delivery. Mandatory law remains decisive.
